Dubois County Prosecutor’s Office Requesting a Special Prosecutor in Investigation of Commissary Expenditures

The Dubois County Prosecutor's Office announced Monday that they are requesting a Special Prosecutor in the investigation of commissary expenditures. 

Dubois County Prosecutor Beth Schroeder filed a request with Dubois Superior Court asking that a special prosecutor be appointed to investigate the recent allegations of inappropriate spending of commissary funds by the Dubois County Sherriff's office. 

According to the County Prosecutor's office,   Indiana Code 33-39-10-2, various grounds exist for appointing a special prosecutor. In this case, subsection (b)(3) provides that a circuit or superior court judge may appoint a special prosecutor if: (A) the prosecuting attorney files a petition requesting the court to appoint a special prosecutor; and (B) the court finds that the appointment is necessary to avoid the appearance of impropriety. 

Prosecutor Schroeder said that she is filing the request because she and Sheriff Kleinhelter are both Dubois County elected officials and she is acting out of an abundance of caution.  She continues to say that this request will allow an independent prosecutor be appointed to investigate the allegations.
