DC Prosecutor Sends Letter to Local Businesses
Dubois Co.- A letter was sent to local businesses from the Dubois County Prosecutor's office.
The letter informs the businesses that they may be selling illegal substances in their stores, and informs them they must stop all sales.
Prosecutor Beth Schroeder says the items are Delta 8, Delta 10, and smokable hemp products.
In January 2023, the state Attorney General’s office released their opinion on these products, saying they violate Indiana law against Schedule I controlled substances. Depending on weight, possession and sale of these products could result in Class A Misdemeanor or Felony charges.
According to police reports, consumers purchase these products thinking they are legal since they are on the shelves of businesses. However, according to the Attorney General’s opinion, that is not the case.
Indiana law does allow some CBD products, as long as they contain under .3% THC. Any smokeable THC products however are illegal no matter how much of the chemical is in it.
Prosecutor Schroeder stated, “Delta 8, Delta 10, and Smokeable Hemp products are creating legal and/or health problems for individuals in our community, and it is the prosecuting attorney’s job to protect the safety of the community. I’m asking Dubois County retailers to stop selling these products based on the opinion of the Indiana Attorney General that they are illegal.”
If the Prosecutor’s office receives information on other businesses selling these products, they will be sent a letter as well.
